A Dallas police officer stands charged with manslaughter in the fatal shooting of a man she mistakenly thought was in her apartment, but a prosecutor would not rule out a more serious charge Monday.

"The grand jury will be that entity that will make the final decision in terms of the charge or charges that will come out of this case," Dallas County District Attorney Faith Johnson told reporters. "We prepare to present a thorough case to the grand jury of Dallas County, so that the right decision can be made in this case."

Amber Guyger, who is white, was off-duty when she shot Botham Shem Jean, a black man, in his apartment, police said Thursday. Guyger told police she thought she was entering her own apartment but was on the wrong floor. Upon encountering Jean, she thought her home was being burglarized and opened fire, according to police.

Botham, a 26-year-old native of St. Lucia, was unarmed. He died at a hospital.

Guyger was released from the Kaufman County Jail on Sunday evening after posting a $300,000 bond.
The fatal shooting happened Thursday night at the South Side Flats in Dallas, where both Jean and Guyger lived.

"A female Dallas police officer returned to what she believed to be her apartment after her shift ended -- she was still in uniform when she encountered Mr. Jean inside the apartment," Dallas Police Chief Ulysha Renee Hall said Thursday.

The police chief said it's unclear what "the interaction was between her and the victim. Then at some point she fired her weapon striking the victim."


The officer called 911 and officers "responded in about four minutes," Hall said.

When I first read about this, they didn't mention the victim was black. What I'm still waiting to hear, is how she got into his unit. He must have left the door open, or at least, unlocked. Which should have tipped her off to notice the different furniture.

Now if her key worked on a unit on a different floor, that would be an interesting twist. And perhaps the only thing that could get her off in my opinion. You don't walk into someone else's home and murder them - "I'm so sorry" doesn't cut it under those circumstances.

The latest story I read says she parked on the wrong parking level. Then went to the wrong apartment. Implied: the apartments have inside parking adjacent to each level. And both levels use the same apartment layouts.

Has anyone read what time it happened at? Weather site says sundown is 7:40 PM in Dallas today. Sunset might have been a few minutes later at the time. If there isn't something tall on your west side, you can have good light for another 20 minutes after sunset.

There's a reason why the official police accounts don't mention basic information like the time frame of when this happened. The interaction between the cop and the victim. How long she was in the apartment before opening fire. Etc. There's a reason why the Texas Rangers postponed seeking an arrest warrant. There's a reason why the story about how she got into the apartment keeps changing. There's a reason why they are claiming it was dark inside his apartment and he "ignored her verbal commands". And there's definitely a reason why they are glossing over the fact that the red doormat outside his door when she was none should have been a big massive clue the she was in the wrong place. The police are setting the state to plan the idea in the mind of the public that this was a "mistake" in order to protect one of their own.

That being said ... they are claiming she came home after a 15 hour shift. So it would depend on when her shift starts.

Meth is great for staying awake, especially if you're pulling a 15-hour shift.
Given that it's never been mentioned in any reporting, I'm betting her fellow cops "forgot" to test her for anything.

I think inebriation may be perceived as a mitigating factor, that may be interpreted in the cop's favor. But ultimately, I think all mitigating factors don't matter: if you are willing to wear a gun, you have to take responsibility for what you do with it. And using it when you are impaired, be it drunk or sleep deprived, it's on you.

What are the chances the cop is getting charged, much less convicted?
I don't suffer from insanity, I enjoy every minute of it.

Blood samples were drawn at the scene by the responding cops. Results have not been released as of yesterday.

Just a legal question: why is the cop charged with manslaughter instead of murder? I'm not a lawyer, but as far as I understand the difference is intent — and it seems clear that the cop had intent to kill when she shot the victim.
I don't suffer from insanity, I enjoy every minute of it.

The argument would be that the intent was to protect herself and her property from (what she thought to be) an intruder in her own home, and not specifically to kill anyone.

Have you been confused by the ever-changing narrative and details that keep getting added to the story of what happened the night Dallas police officer Amber Guyger shot and killed Botham Jean—an innocent black man who was minding his own business in his own apartment?

If you are, you are not alone. At this point, even law enforcement is confused by the round-robin tale that continues to evolve as the days go by. They are seemingly so confused, two different versions of her story appear on two different warrants related to the case, according to the Fort Worth Star-Telegram.


Guyger, 30, shot and killed Jean, 26, on Sept. 6 and was subsequently charged with manslaughter. She claimed that she mistakenly entered Jean’s apartment thinking it was her own, and shot him because she thought he was an intruder.

The arrest warrant for Guyger, written by Texas Rangers Officer David L. Armstrong, is based on Guyger’s account of what happened. She told authorities that she “inserted a unique door key, with an electronic chip, into the door key hole. The door, which was slightly ajar prior to Guyger’s arrival, fully opened under the force of the key insertion.”

Once the door opened, Guyger said the apartment was dark and she thought “she had encountered a burglar, which was described as a large silhouette, across the room in her apartment.”

Guyger claimed she drew her weapon, “gave verbal commands that were ignored by (Jean),” and then fired two shots. Jean was hit by one of the shots and died from his wound.

The arrest warrant was made public on Monday, and the version of the story it tells differs from the one which appears in a Sept. 7 search warrant that was signed by Judge Brandon Birmingham.

The search warrant says, “An off-duty Dallas Police Officer, who was wearing a full Dallas Police uniform, was attempting to enter apartment number 1478, with a set of keys. An unknown male, inside the apartment, confronted the officer at the door. A neighbor stated he heard an exchange of words, immediately followed by at least two gunshots.”


In the arrest warrant, Jean is said to have been across the room. In the search warrant, he answered the door. It is also worth noting that the arrest warrant does not include the statements of any of the neighbors, some of whom said they heard a confrontation at the door before Jean was shot.

Lee Merritt, an attorney for the Jean family, said Monday that two sisters who are residents of the building gave statements to police that contradict the arrest warrant.

“One happened to be in a quiet room reading a book so she was in the best position to hear things,” Merritt told the Star-Telegram. “She heard pounding at the door. The other one (witness) was in the living room (of her own apartment) watching TV. She also heard the same pounding at the door.”


The warrant to search Jean’s apartment was looking for specific evidence including shell casings, bullets, firearms, ballistic vest, keys, possible video, any narcotics and and other trace evidence such as blood.

The warrant became public record Wednesday, and according to Fox 4 News, the items retrieved from Jean’s apartment were as follows:
  • 2 fired cartridge casings
  • 1 laptop computer
  • 1 black backpack with police equipment and paperwork
  • 1 insulated lunch box
  • 1 black ballistic vest with “police” markings
  • 10.4 grams of marijuana in ziplock bags
  • 1 metal marijuana grinder
  • 2 RFID keys
  • 2 used packages of medical aid

Of all the warrants that have been issued in the case of Amber Guyger shooting Botham Jean to death, only two have been made public—Guyger arrest warrant and the warrant to search Jean’s apartment. Everything else, according to Fox 4, is sealed.

So, it is unlikely that we will find out what was in Amber Guyger’s apartment the night she shot Botham Jean. We probably won’t learn what was in her pockets. We won’t hear about how she stole out of the collection plate at church when she was younger.

What we will hear, however, are the continuously changing versions of her story.

We will also likely see and hear more stories that attempt to assassinate the character of Botham Jean and make him complicit in his own death as Dallas law enforcement scrambles to protect one of their own.

See here for a video by a neighbor in the same apartment complex who is disputing "Officer" Guyger's account that Mr. Jean's door was "slightly ajar". Apparently all the apartment doors automatically shut on their own. There's no way for it to have been ajar unless one props it open with an object. Which would explain why the neighbors said they heard banging on his door.

Police in the California city, where only 6% of the population is black, worked with federal authorities to arrest 37 people, all of whom were black, for selling small amounts of drugs, the American Civil Liberties Union of Northern California said in a complaint announced Thursday. During the operations, one undercover officer was caught on camera declining to buy drugs from an Asian woman and waiting to buy from a black woman, who was later prosecuted.

Those who had already pleaded guilty -- their cases were not dismissed.

Babysitting while black.

A brave superheroine busted up a nonexistent child trafficking ring on Sunday when she noticed a black man riding around with two white children in his car and alerted the authorities to a kidnapping in progress.

CBS 46 reports that a white woman who was temporarily working for the Avengers (which, it must be noted, was not fully staffed after half of its workforce disappeared in a tragic Thanos-related work accident) spotted Corey Lewis at a Marietta, Ga., Walmart.

The unnamed woman saw Lewis, who is black, suspiciously riding around with two non-black children. Although The Root cannot confirm whether or not the woman had been bitten by a racist spider when she was a child, that’s when her whitey senses kicked in.

SuperBecky immediately approached Lewis and asked him if the children were OK. When he replied that they were, the woman summoned her white privilege superpowers and asked if she could speak to the children herself. While people on the woman’s home planet of Krypton might be totally fine with letting their children talk to strangers, Lewis declined, citing an ancient African maxim: “I don’t even know you like that.”

Undeterred, our brave Blunderwoman followed Lewis to his home in an attempt to thwart his villainous plans. But before Lewis could take his captors to his secret super villain laboratory where he did evil experiments like season chicken, the woman called for reinforcements from the League of White Justice, also known as the Cobb County police.

Lewis recorded the police interaction (because this ain’t Gotham, you never know) as he explained that he was simply babysitting the children. In the video, the 10- and 6-year-olds, seemingly unaware of this racism thing we speak of, told the police officer that they were fine and they were being watched by Lewis.

“He’s babysitting us,” the oldest child tells the officer. “And this lady started following us,” the girl explains as the cop repeatedly asks the children if they are OK.

Lewis told CBS 46 that he runs a mentoring program called “Inspired by Lewis,” which ironically inspired at least one woman to call the cops on him because the children exhibited no signs that they were in danger except for the fact that they were in the company of a Negro.

Although no one has identified the woman who called the cops, she is not thought to be hiding out in Wakanda.

Accidentally brushing against a white woman with your backpack while black.

Surveillance video now proves that a 9-year-old boy never “sexually assaulted” or “groped” a white woman inside a Brooklyn deli. Theresa Klein called 911 accusing the boy of the despicable act. People at the scene disputed her version of events all along, but now the video footage vindicates him as well.

According to the surveillance footage posted on the Twitter page of Andrew Ramos, a self-described “multi-media journalist in New York City fighting evil,” who works with local station Pix11, it appears the boy’s book bag may have grazed the woman as he and his family passed her.

Onlookers outside of the Brooklyn deli disputed the woman’s claim immediately, according to an earlier article in theGrio.

“Are you seriously calling the police?” another white woman said, irately confronting the caller, who then begins to argue with her “one white girl to another,” the Grio said.

A man started filming Klein, whom he dubbed #CornerstoreCaroline, as she called the cops.
The boy, his mom and a handful of other children are standing around confused at the day’s event. The video, which was posted on Facebook, has since gone viral with now over 4 million views since Wednesday.

“The son grabbed my ass,” Klein told the police operator as she stood on a Brooklyn corner. “I just was sexually assaulted by a child.”

The woman made the call from Flatbush, Brooklyn, a neighborhood under the jurisdiction of a New York State senator who proposed a law that penalizes people for making frivolous calls against blacks, according to The Grio.

The woman seen in a viral video confronting and blocking a St. Louis man from entering his downtown loft was fired from her job Sunday.

Tribeca-STL, which says it is a minority-owned business, released a statement Sunday afternoon saying its owners were "disturbed" by the interaction in the video.

The company confirmed the woman in the video was an Tribeca-STL employee but the incident took place at her personal residence.

Cellphone footage captured the confrontation between the two tenants showing the woman stopping a man from entering his downtown loft and demanding proof he lived there.

D'Arreion Toles was returning home from a late night at the office when a tenant who lived on the third floor of Elder Shirt Lofts created a roadblock.

In the viral video, Toles can be heard telling the woman, "You are blocking me into my building. This is my building as well. So, I need you to get out of my way."

The woman then begins to questions Toles by asking what unit he lives in.

Toles showed a key fob in the video and moved past the woman, who News 4 will not name, before taking an elevator to the fourth floor.

In the video, the woman is seen following Toles to the front door of his loft.


"Did this really just happen to me. It happened to me. I am really taken away by the moment," said Toles reflecting on the incident.

His cellphone video shows the woman standing outside his door after he uses his key to enter his loft.

"I was kind of blown away, shocked and like wow," said Toles. "I am just glad I had my camera out. If I did not have my camera out, I feel it could have gone a totally different way."

The video has over 2 million views and has been shared over 70,000 times.

"I appreciate all of the love and support. Like I said, don't respond negatively. Don't go after the lady. Let her be at peace. Let her live her life," added Toles.

News 4 buzzed the woman's unit and also called numbers listed for her to get her side of the story, but she never answered.

"I am not mad at her. I am not upset with her. I am not going to go after her legally or anything like that. I wish her the best. I would still have a conversation with her," said Toles.

Toles told News 4 that police showed up at his loft but left without giving anyone a citation.

Participating in an anti-violence rally while black ....


Black Charleston, S.C., residents are calling for the firing of a white gas station manager who recently called the cops on a group of anti-violence protesters for the awful crime of hanging out outside a gas station while a few of their members went inside to make purchases.

In an even more bizarre—though, unfortunately, not exactly surprising—twist, most of the protesters were children.

According to WCBD TV, Charleston community activist Jonathan Thrower, who goes by Shakem Akhet on Facebook, led dozens of black adults and children in an anti-violence walk on Sunday. The group had just concluded the mile-long protest, “Guns down Chucktown: End to Gun Violence,” when they stopped at the Murphy USA Express gas station to get some refreshments for the kids—who comprised the bulk of the group.


While the group paused outside, a white couple pulled up in a red pickup truck. The couple called 911 on the group, with the woman, identified as Brenda Metz, hopping on the phone to tell dispatchers that the walk participants were “destroying” the outside of the station.

Thrower recorded the woman—who’s being referred to as “Gas Station Gail,” according to the Huffington Post—talking on the phone and walking in and out of the store. Participants in the march can be seen holding their signs and chatting with each other, trying to figure out what was happening.

While what she says is unclear in his video, the Charleston City Paper obtained audio of Metz’s call to the North Charleston dispatcher.

“They’re standing outside my store, they’re videoing us and everything, I need a police officer here now,” said Metz, who was later identified as a store manager for Murphy Express. She told the dispatcher the group was knocking gas pumps down and “absolutely destroying the outside” of the gas station.

Metz added, “I mean, it’s like a riot out here.” Meanwhile, the protesters were literally standing outside, holding “Stop the violence” posters.


At one point, a dispatcher asks Metz if she feels like she’s in danger.

“No, no we just want a police officer to get here,” she said.

Thrower told WCBD TV the whole incident “happened so fast.”

“We were literally just standing there and boom,” Thrower said. “The only thing I could think in the back of my mind is, this lady is crazy.”

Cops did end up responding to the call, but the group had already dispersed by the time they arrived. Thrower said he applauded the police department’s response to the bogus call.

The [officer] was like, ‘You know, they’re just coming in to purchase something, I’m sure they‘re not causing any trouble,” he told WCBD.


Still, Thrower and other North Charleston community members are calling for a boycott of Murphy Express, which in a statement, seemed to back up Metz.

“Safety issues arose due to people, many of which were young children, being in and around the flow of store traffic, and disruptions to the business were caused by an external emergency fuel stop button being struck numerous times, which shut down all fuel pumps at our site,” Murphy USA said in a statement, according to the Huffington Post.

Thrower also wants Metz fired.

“A lot of the children were distraught,” he told WCBD TV. “They were saying why is it when we do something good, something still ends up going wrong?”

Parking your car while black ....

Another day and another white woman is becoming an Internet sensation for calling the police on a black man who parked his car too far into the crosswalk for her liking. I miss the old days when passive aggressive white women wrote notes and left them on your windshield.

Portland, Ore., couple Rashsaan Muhammad and Mattie Khan were running to grab a quick bite to eat at Big Burger when they spotted a woman bearing the skin color of an American terrorist standing across the street looking at their parked car.

“She looked odd, but it didn’t alarm us,” Muhammad told the Portland Mercury. They didn’t think much of it and went on to grab some food. When they returned with their to-go bags, they knew something was going on. Muhammad told the Mercury that the woman was on the phone, which is becoming the first sign of trouble as emboldened white women having been deputized by no one have become America’s first line of defense in keeping America safe.

Khan noted in a Facebook post that she could hear the woman giving the couple’s license plate number to whom they assumed was the police.

“I tried to start a conversation, I asked her who she was calling and what was going on,” Muhammad said. “It was clear she was talking to the police.”

Khan used the anti-racist defense tactic of recording the interaction, which would lead to a hashtag, internet infamy and possible firing from one’s job.

“You can’t block the crosswalk,” the amateur parking inspector says. “Look at this. You are!”

The woman also added that she lived in the neighborhood. The video doesn’t show the car fully but the Mercury notes that the car is clearly sticking out an inch or two in front of the curb and therefore into the crosswalk. The Root would also add that the woman is probably not racist because she has yet to burn the Nikes that she is proudly wearing.

Muhammad said that he knew his parking spot was tight but figured it was cool because they were just picking up a quick bite to eat and going about their day. It should also be noted that the video does not show the 1,203 pile-ups that did not happen when cars tried to ease past the egregious parking job.

“She didn’t try to talk to us. She just called the police,” Muhammad said. “Why would people spend the time just trying to make our lives harder instead of talking it out like neighbors?”


The couple waited a few days before posting the video to Facebook.

“It’s part of a bigger problem that we as a community need to address,” Muhammad said. To him, the interaction was less about the color of his skin and more about lack of communication and empathy in a changing neighborhood.

“New people come in and change a neighborhood and it causes these kinds of stressful situations,” he said. “We don’t interact with each other the way we used to.”

Muhammad did not say if he was issued a citation for parking, obstructing official white business or “Carolyn’s Law,” the 1955 statute inspired by Carolyn Bryant’s Emmett Till tale that penalizes black men for staring too hard at white women.

Update: According to a source close to the woman (who asked to remain anonymous), she was on the phone with Portland Bureau of Transportation's parking enforcement hotline—not the police.

At least she called the right department. The meter maids handle parking tickets.

If she didn't know they were black when she called, then I'm not ready to fault her. Racist angle might not exist. Though I'd rather she reported someone parking in a handicap spot.

Yeah this one may not have a racial angle. Probably more of a "somebody needs to mind their damned business" angle.

Since the problem is they did not vote, Trump (or Cohen) did not call the cops on them. How refreshing. One wonders what the charge would have been.

Being a security guard while black ....

The headline should have been: “Security Guard Apprehends Shooter and Saves Lives.” Instead, it’s another case of the police shooting and killing an innocent black man.

Eyewitnesses say that at Manny’s Blue Room Bar in Robbins, Ill., security told a group of intoxicated men they had to leave. One of the men returned armed, at which point shots were exchanged between them and armed security guards.

One of the guards, Jemel Roberson, 26, managed to restrain one of the gunmen.

From WGN9:

“He had somebody on the ground with his knee in back with his gun in his back like, ‘don’t move,’” witness Adam Harris said.

Two police officers arrived, and upon seeing the scene, one of them immediately shot Roberson before taking the time to better assess the situation.

“Everybody was screaming out, ‘he was a security guard,’ and they basically saw a black man with a gun and killed him,” Harris said to WGN. He was just doing his job—and had managed to do so without using fatal force, as the four people wounded had only nonfatal injuries.

I keep trying to wrap my head around the police officer’s decision here. Did he think it was a hostage situation? Still doesn’t make sense. Did he say anything before shooting Roberson? Probably not, and still wouldn’t make it OK. This man had ostensibly saved lives, and the police chose to end his on a kneejerk reaction.

From WLS-TV:

Those who knew Roberson described him as a man of God who shared his musical talents at several churches around the city, last rehearsing at this South Shore church on Thursday.

“He said, ‘Ma and pops, I’ll see you all Sunday and I jokingly said, ‘You better make sure you’re on time for morning worship. He said, ‘I’ll be there pops. I’ll see you then,’” Turner said.
Friends and family say Roberson had plans to become a police officer. Maybe he could have taught them something about resolving a situation without resorting to lethal force. We’ll never know now.
