Does anyone know what would happen in CA if Davis were to step down before the Recall Election?
My guess is that the recall would become null and void, since Davis was no longer in office. If that is the case, Davis could step down in order to let the Lt. Governor have his seat and guarantee that the democrats retain the position.

That's a darn good question.
Although, the case could be made for the fact that they wouldn't just be recalling HIM, they are recalling the ELECTION of him, therefore, stepping down and putting someone else in would not make the recall void.

From what I've read it would stop the recall from going forward but it won't happen. Apparently Davis and the Lt. Governor, Bustamonte, really do not like each other.

For some reason I doubt it.
The recall election is intended to recall the previous election. Since the Lt. Govenor is part of the "package", the same "package" that's being recalled....
By definition I would think he's null as well.
Perhaps someone can clear this up?

I think under law he cannot step down now but since he is a Democrat the law means nothing so watch out. If they can do anything to hold on to power (keep a Democrat in charge) the law means nothing.

Since when is there a political office you can't step down from?
The ability to quit at will is what sepearates it from being a "position" or "job" than "slavery".

I heard that on CNN, even if Davis steps down, the recall process has begun, and cannot be stopped until completion.
I hate this recalll thing. Just as the presidential primaries are gaining news...bam...they go to something else.

The recall is for the election, not Davis. Davis is the reason for recalling the election.
The recall esentially nulls the first election.
So anyone hired though that election, is esentially jobless. Once the recall has started (the people decide, they will recall the previous election).

I wonder..if the Republicans win this recall.can the Dems go out and form another, with enough petition signatures?
What will the Republicans think then? "The Dems are playing politics?

Sure, Dems (or anyone for that matter) can try and recall whoever is elected - and most probably they WILL! (If history and THIRTY-ONE prior recall attempts is any indicator). The chances of them getting the required signatures- despite all the hype from people who love to blindly ignore the past GRIM track record of a successful recall effort- are MONUMENTALLY SLIM.
What will the Republicans think then? "The Dems are playing politics?
No, they'll think, "Oh gee, look at that. There's recall petition number THIRTY-THREE, just like clockwork. Ho hum. Lets see the recall is 1 for thirty-two GREAT track record of success there! What are Vegas-odds on this one? Im sure Ahnold* is just quaking in his boots!"
*Or whoever else wins. Personally I'm hoping for Gary Coleman, just so he can use the line: "Watchoo talkin' 'bout Davis?"
