If it was scratched I'd be a little upset too. Maybe you should unwrap it to make sure it is not the plastic. Then if there is a scratch, call Apple.

Why am I not surprised! I had the same problem with my 60 gig. video iPod, but I just chalked it up to your typical Chinese quality control.

I don't think that's called for. A huge percentage of all products produced on the planet are now made in China. Some are good and some are not. It has nothing to do with them being Chinese.

After receiving three 4G iPods and one of the first 2G Nanos, I have been quite impressed by the quality and consistency of iPods. The Nano packaging is extremely innovative too.
I don't see this as a "scratch" as much as a problem with the anodizing. Anodizing aluminum requires that the chemistry stay consistent and that the aluminum to be anodized is ultra-clean. A bit of skin oil, a bit of an aluminum shaving from the manufacturing process, any or these could have gotten in the way of the solution and made for a bit of a difference in the color. What color did you get?

umm, it's personalized. if i remember correctly, doesnt Apple have an anti returning for new one if old iPod is personalized thing? or did i remember incorrectly?

Sorry, it was not my intention to imply that race had a factor in the quality control in China, however when freedom of thought and expression is suppressed by a central government how happy can their workers be?

This is actually one of the things I'm wondering. The "Terms & Conditions of Sale" that Apple attaches to invoices mentions this, but it's a little unclear.
The "Return & Refund Policy" says personalized iPods cannot be returned or refunded.
But just below that, the "Defective Items" section says that any defect would be covered under the product warranty.
So which would this fall under? I'm hoping the latter because getting stuck with a defective item just because it's personalized seems like a terrible policy.

I think that it would be covered. What I believe they mean by that is that if you don't like it you can't refund it.

hmm, if someone at the place that engraves the iPods messes up and the engraving wanted was: "my gf is hot" and instead got "my gd is hot" would that be covered under defective as well, even if no scratch?

I doubt if that is possible -- I don't think they have some guy manually typing in the inscriptions. That said, I'm sure they would help you out if something like that did happen.

Glad you got it worked out. I was going to say that your nano coming scratched might be a blessing, since it will inevitably end up that way anyway. I've kept mine in a rubber case from the moment I took it out of the box, and it's scratched all to hell. I've never used it out of the case cause it looks better with the case on. Some of the scratches could probably be buffed out, but what's the point if that's what it's going to look like even when it's protected.
P.S. This was not one of the early nanos with the "bad quality control batch" or whatever Apple was calling it.
Still, I love my nano. I think beautiful things (laptops, cars, a new pair of white sneakers) are easier to fully enjoy once you've gotten past the stress of trying to avoid that first scratch.
