Well, if the ambient temperature is 70˚, and it's in direct sunlight, then you'll easily surpass the iPad's operating high temp of 95˚. The iPhone/iPod touch displays the same message.

So I guess taking the iPad down to the beach in Aruba will be out of the question for me... Will leave in room I guess... Are kindles and nooks the same way where you can't use them outside...

I've used my for hours poolside in Vegas (hot!) and the kindle is fine. But considering the difference in the two devices no surprise.

Shade can cut temperatures significantly. Maybe using it under a beach chair's umbrella?

I took my ipad to the beach in atlantic city a few weeks ago and even with maximum brightness and an umbrella I could barely see anything. I say leave it at home.

I should add that I had mine in an Apple case as well. It was humid and 90º.
I've only seen my iphone say that it has overheated once in 3 years.

You leave anything in direct sunlight and it's going to fry, especially when it's 35-40C without the direct sun.

A client of mine has this problem.
30-degree weather, in the Apple Case. Fifteen minutes in direct sunlight - off.
He didn't seem like a gold-digger to me, and lawsuits don't have quite the same fashionability over here as they do in the U.S.

Apple could release a #2 iPencil and some idiot lawyer would immediately form a class action lawsuit for some reason. With no negative repercussions, people (in the USA) will sue anyone and anything.

But this isn't on an individual basis. If the iPad's internals surpass 95˚ it WILL shut down. What's stupid is people are making a big deal about it.
