Brazilian government looks to fine Apple, Vivo over defects

Brazil's Public Ministry has filed legal action against two companies, Apple and Vivo Participac�es, for breaching the country's Consumer Protection Code, says Terra Brazil. The Brazilian government alleges that the businesses are failing to assume liability for defective products. Action was taken, Terra Brazil reports, after a woman complained that her iPhone wasn't replaced by either Apple or Vivo.

The Public Ministry is aiming to fine the companies 10,000 real (about $5,033) for each instance in which someone was denied a replacement for defective hardware. It's not clear how many other complaints the government has received. Apple has had a rough experience in Brazil in the past few months. While more of the company's products are being produced in the country, it may soon lose the iPhone trademark in the region. More likely is that Apple will pay for the rights to the name, since it would take a large financial hit if it couldn't sell the iPhone there.

Unfortunately, I had an experience with Apple trying to deny a warranty claim on an iPhone recently. The phone suddenly failed to take a charge and wouldn't turn on, so it was sent in to AppleCare for service. They denied the claim, saying that they opened it up, and found that the liquid contact sensor inside was supposedly tampered with. They sent a picture, and the sticker was simply installed about a millimeter off from where it should have been. Obviously something that happened during manufacturing. So it took several phone calls, emails, etc until the finally agreed to send a replacement. What should have been a simple swap turned out to be a nightmare that took almost 2 weeks.

Why? Because they need to respect their own warranty, and local consumer protection laws?

Well, golly gee, I guess Apple needs to 'get the hell out' of every country then, since the same will be expected of them everywhere else too!

You must probably live in Alabama or some other backward area to utter such stupid comments.

Brazil, as any other civilized country, is simply applying its 20-year old laws on consumer protection. If you don't know jackshit about it, just shut the fuck up instead of spouting nonsense.

And no, Brazil does not speak Spanish, as you may probably think.
