I have had my 5 GB iPOD for aout 6 months now, and it's just now died. I was wondering if the iPOD's warranty would allow me go send send it back to apple and get one of the new iPOD's, since they are the same price as i bought mine for.

You will definetly not get a new-style iPod from apple (assuming they even allow you to return your current one).

I don't know if they'll replace it with a new 10 GB one, but you never know. They will replace it at least, under the 1 year warranty.

Not neccessarily. They refused to replace my old 10gb because it was "user-related failure". Which it definetly wasn't.
