Eminem's Music Publisher Sues Apple Over Downloads

This suit is apparently over Apple allowing people to put illegally downloaded songs on their iPods.

I believe this is about selling them in iTMS. The argument is that the record label didn't have the right to allow this without consent from the music's publisher, the label and the publisher being two different entities. I assume the publisher gets jack squat from electronic sales and is therefore pissed that these sales have hurt the physical media business, where they would have received payment. It may well be that they have some agreement that prohibits other distribution of the works.
