Samsung declares plans to appeal Apple's $120M in damages

Samsung will appeal the nearly $120 million in damages awarded to Apple during the companies' second US trial, according to a lead attorney for Samsung, John Quinn. "Of course we're pleased that the jury awarded Apple 6 percent of what they were asking for," Quinn comments in an official statement. "But even that can't stand, because Apple kept out all the real world evidence and didn't produce anything to substitute for it, so you have a verdict that's unsupported by evidence - and that's just one of its problems."

Apple had been demanding almost $2.2 billion in damages for infringement of just five patents, while Samsung was claiming a little over $6 million based on two patents. The jury found both parties culpable, but apart from awarding Apple less than $120 million, granted Samsung only $158,400.

Samsung needs only a partial success to make an appeal worthwhile. Even bringing down the damage payout by $10-20 million would be worth the time and expense, notes Villanova University law professor Michael Risch.

And of coursel to date, Samsung has yet to pay a penny for any of the judgements it was libeled.

With that small of an amount I don't see why they just don't pay it. Maybe the punitive damages will be bigger?

Wouldn't it be funny if they appealed it and the appellate court agreed the damages were not correct, then moved the decimal point to the right a couple places?

It's possible that this time, Judge Koh will actually levy some punitive damages on Samsung. In the first trial, she obviously felt that the jury did that for her and refused to triple the damages (as should have happened, since the jury found Samsung wilfully infringed) or issue product bans.

Given that this time the jury stuck strictly to what they thought a royalty should be, possibly the judge will deign to issue some actual punitive damages this time, maybe even a product ban. I'm not holding my breath, though, and consequently I'm betting there will be another double appeal.
