California was the first to deny Microsoft a subpoena of Sun and Oracle documents in regards to the EU antitrust trial because, as the judge said, this is a case in Europe, not the United States, you're not getting these documents.
Microsoft has now asked a judge in New York for a subpoena for documents from Novell. The New York judge basically just told them to suck it up. This is a European antitrust case. You are undermining the E.U. judicial system by requesting a subpoena in U.S. courts, we will not help you break the law.
This was Microsoft's last chance. From here, they'll be fined 2 million Euros a day. Not much, but it'll be the first time ever that Microsoft will actually be penalized for their anticompetitive practices.

EUR 2 million a day is nice.
That's quite a bit of money for a whole year. Almost 1 billion $ per year.

Nope. They tried, but it came too late. Had the Democrats stayed in power the case might have had a better chance. Note that this is not a slam against the Republicans either.
Had the case started during a Republican administration and continued into a change of power into the Democrats, I could easily see the same outcome.
Nice that the judges in both California and New York butted out of European affairs

Exactly. It was the chaning of the administration which hurt its chances. The reason being, of course, is the donations from Big Business to whatever candidate that might win. They then get kickbacks from the candidate when they're in office. In this case, Microsoft got the penatlies all but dropped. In a few states, they actually got rewarded.
