Ha, LOL, police shot themselves in the foot.
But doing an illegal search, all information obtained will be automatically dismissed in court.
They gained nothing, and potentially lost valuable information.

Is this police action possibly at Apple's urging?

I haven't read what he's accused of? I'm assuming he's not just in trouble for "refusing to disclose the source of any information procured while blabla". The search warrant is probably invalid under that law, if we don't know what he actually is being taken down for, it's hard to say?
o wait, this is all a publicity stunt anyway. iphone 4G sales, here we come!

No journalist is protected against charges of fencing stolen goods, AFAIK.

Doesn't matter. If the evidence is obtained unlawfully, it can't be used in a court of law.

There was nothing unlawful about the search warrant and confiscations made.
Gawker quoted Section 1070, which prohibits search warrants against journalists on grounds of being "adjudged in contempt … for refusing to disclose … the source of any information procured while so connected or employed for publication".
Whatever that has to do with knowingly purchasing stolen goods, God only knows.
This search is not about revealing who stole the phone (and it *is* stolen according to Cali law); it's about determining that Chen (and his employers) must have known that the item his corporation was willing to pay $5000 for (by their own admission) was stolen, or at least failed to take even the most basic measures to verify that it hadn't been.

I think that the quoted section that Gawker is using to try to dispute covers all sorts of publication types. Doesn't need to be a traditional journalist I suppose. I certainly don't consider Gizmodo to be a traditional journalist publication. They are the tabloid of the gadget blog world, in my opinion.

Like Gizmodo? Yes. Gizmodo themselves? No. They're almost as bad as TechCrunch.

Yes, Gawker employs journalists. Not liking how they choose to practice journalism doesn't make them not journalists.

Same here. Unless it's meant to replace the 8GB 3G on the low-end.
However, since this is just a prototype we're not certain they will actually ship it. Recall the 4GB 5G iPod nano.

That one was sold for quite a while, but it was just a stopgap until Flash shortages eased out.

I'm hoping the largest model tops out at 64g. I'd like to be able to put as much on it as I do my iPad.

I can't recall where I read about it, but that inferno is designed to test screen burn-in time.

I just don't understand how the hell these phones keep getting into other people's hands. I've been wondering if Steve will joke about all the leaks at the keynote.

In the video, it looked briefly to me like the lock switch was fiddly and badly aligned.
Worst nightmare: this thing is not an Apple iPhone, but a clone based on Gizmodo's stolen one.

I think he will just make a joke about it as I remember he did that once on previous leak a few years ago. "Here is the new thingamajig. You may have seen it".

I'm thinking it might just be the new $99 model if anything although it kinda cheapens the image to me if the $99 cheapo 3G replacement looks and acts just like my maxed out (hopefully 64 gig) $300 version

I think Spheric is right. This looks more and more like a clone of the phone featured in the Gizmodo article.
The IR receiver in the device tree is interesting.
That's a full sized SIM card slot. Not a micro.

Man I'm still not diggin those seams. I really hope they make it unibody in shipping unit.
Unless they are conceding to the users who want a removable battery. If so, for shame!
And then there's the possibility that these are both bogus and we get something completely different. Ooohh it's like trying to figure out how Lost is gonna end! <giggles>

It wouldn't surprise me at all if Steve delays the next iPhone release so that Apple can redesign the shell ... just to spite everyone who dared look at it before Steve holds it up on stage for all to behold in wonder at his mastery.

Same here. Unless I get something out of it (like simple battery replacement - which I'm pretty sure won't happen) I want them gone.

Because the numbers on that chip are almost identical to what the iPad has? But that's obviously not an iPad logic board.
If this is a clone, then it's a pretty excellent one, to be running some version of OS 4.0, and to appear to have better build quality.

In my estimation, the vietnam iphone/video/etc is a fake/clone/whatever. Further, there is nothing in their presentation that links the video of that "phone" with the inferno screen with whatever pile of chips are shown sitting on a blue towel.

Oh boy, Gizmodo really dug themselves into a hole - add "extortion" to the list of criminal offenses:
Gizmodo e-mail to Jobs: 'We have nothing to lose' | Apple - CNET News
Jesus ****ing H. Christ.
What complete nimrod would write an e-mail like that without consulting the legal department - or even just some friend with a law degree?
That's about six levels of awesome right there.

Slam dunk.
No, of course it's a clone. They just happened to get Apple to make them an A4 for their clone. No wait, that's not an A4. It's just a clone of an A4. With an Apple logo. To make it look more genuine.
