It's in the Star Ledger but I couldn't find that article online. Here's a snippet from the Minneapolis Star Tribune:

Blockbuster doesn't tell customers that late rentals are converted to sales on the eighth day after they are due, the lawsuit claims.


Stores that are not participating in the new policy also fail to make that obvious, the state said. The lawsuit, filed in Trenton, seeks restitution for customers charged late fees at those stores and for customers whose overdue rentals were converted to sales.

Several states are considering this, NJ was just the first to go ahead with it.

Well, if they've got a big banner in the window saying "NO MORE LATE FEES" and nobody mentions when you rent a movie that if you keep it for 8 days they just charge you for the cost of the movie, i'd say that's fairly deceitful.

I actually had a sales assocciate in Blockbuster explain it to me. So it is people's fault if they don't have an explaination about it. But no late fees. Not There are no late fees but we charge you a week later if you don't return the movie. When you return it we credit your card back

I heard them explain it like 10 times to different customers while I was waiting in line. I guess if no one tells you, it would be deceitful, but you can return it after 8 days, and they charge you a $1.50 "restocking" fee.

Better than a $5.00 late fee.

Side note, if they do convert them to a sale, you can take them back and get a voucher for the money you spent on the purchase.

I think suing Blockbuster is a GREAT idea.

Here's why:

1. You sign up for "No more late fees!" account
2. They automatically debit your account $24.95 for each month
3. If your movie goes back on the 8th day they WILL charge your account an additional $1.25 for "restocking fee." Per video. Yes, they deem it necessary to charge $1.25 to walk 20 feet and put a movie back on the wall. THAT IS A LATE FEE NO MATTER WHAT THEY WANT TO CALL IT.
4. They have "the RIGHT" to charge your account - automatically - between $19.95 all the way up to $99.95 to cover the cost of the movie that you just inadvertently "bought" if you keep it longer than they deem appropriate. (Usually that's 30 days.) This is never mentioned by the sales associate and is in the fine, fine, fine print.

Guess what happened to us this week? They made a "mistake" and they charged us $4.53 for a late movie...even though we're on the "movie pass." They charged our account automatically without even calling us!

Guess what else?

THERE ARE NO MOVIES TO RENT WHEN YOU GO TO RENT A MOVIE...

Why?

BECAUSE THEY ARE ALL OUT - RENTED TO THE PEOPLE WHO WILL NEVER RETURN THEM BECAUSE THEY HAVE THE "MOVIE PASS."

See what I'm saying? So, the rest of us people who would ordinarily return a movie say, three or four days later, now have no movies to rent. You go there day after day after day for nothing because they don't have any "new releases" because they are all out with the people who have movie passes and have no incentive to return them for up to 30 days.

So, we're forking over $25 a month for what? For renting old movies that are left over because everything else has been rented out.

I'm totally into signing my name to a class action lawsuit against FraudBuster - er, BlockBuster Video.

Yeah. Bring it on.

Screw Blockbuster. I'll keep going to my local indie place and get cheaper rentals and far more exotic movies and TV shows than the top 20 crapola that Ballbuster has. Ah, it's nice to have choice.

I usually return my rented movies after about an hour (just long enough to rip it). I just they had an hourly rental rate.

Honestly, what kind of business could you think they're runnig?
It's completely unreasonable to think that there isn't a catch. For sure BB could make it easier by explaining it, but not asking is just dumb.

They'll never guarantee a movie again, not with movies never being returned.

Hollywood Video still guarantees movies, though.
