In the U.S. the father would have custody regardless of marital status. If the father was seen unfit, generally the mother's grandmother is granted custody, though any member of the family may petition the court.

I can see how the law may have been put in place to keep people from taking advantage/abusing the handicapped... however it seems they've separated a family for no reason, here.

This is awesome.
I've been for forced sterilization for awhile - this is one step in the right direction.
And yes, I'm serious. A huge part of why the United States is such a mess now is because of how many idiotic people keep popping out babies that they are completely incapable of raising properly - and, more importantly, can't afford to raise. Which means that you have exponentially more stupid children who live off welfare and can't hold a steady job or contribute anything worthwhile to society. Which means that we end up where we are today. It also means that hundreds of thousands of Americans are drowning in debt thanks to procreating before their bank accounts could handle it.
I know, I know, if we get rid of all the idiots, who will clean the toilets? That's the only part I haven't figured out yet.

The girl is not a every day stupid teenager; she is handicapped; which means that if she is in trouble she will not know what to do uneless she is well supervised.
Even if they take this one away it does not mean that she won't get pregnant again and again unless someone sits down with her and explains what is happening when you have unprotected sex. Regular teenagers most of them think that having a baby means that they will be loved forever and idealized the situation. Imagine a handicapped person. She is not stupid just she does not know any better.
