Upgrade without losing unlimited data

I'm looking to get the iPhone 5 next week and want to make sure I don't lose my unlimited data plan. In the past there was some problem where if you upgraded through Apple you couldn't keep the unlimited data and so you had to get the phone from AT&T. Is that still true?

AT&T screws us anyway. They just cheat us by slowing speeds down to analog speeds if we start using too much data, making our "unlimited" data plans moot. Even though we paid extra for years to maintain such plans.

Switch to Sprint.

Some of these prepaid plans look pretty great, though. I'm starting to wonder if I should switch.

Yeah, it's AT&T policy to throttle unlimited users to edge speeds at 3GB usage.
