Since adultry is still something of a crime in many countries (at least to the extent that it can alter the outcome of divorce proceedings) could someone not sue this site for libel if they are listed on it?

Unlikely. Publishers and ISPs are not responsible for the content posted by users on their servers. As long as content is removed upon request it's highly unlikely that anybody can sue anybody for anything.

Incorrect. Publishers are responsible for content posted to their servers, even by users - at least here in the UK. I know this because a couple of years back a forum I used to frequent was on the verge of a court case for the very same thing. Fact is, you *cannot* post personal data about someone who isn't already in the public eye without their permission.

Sorry, but you're wrong on this occasion. I know this because we did due diligence on this for a company I am involved with - in the UK no less. You cannot sue without giving the ISP/bookstore/publisher a chance to remove the offending material first. The law is designed to protect distributors of content from malicious lawsuits.

No, you're still protected. But you need to give the publisher a fair chance to either reply to your argument or remove the offending comment before you can sue. If you don't get the result you're after then you can sue.
