As far as I know, this is perfectly legal. As long as your friend doesn't use a copy of it after he has sold it to you.

If he sold it he can't legally use it any more.
Nasrudin sat on a river bank when someone shouted to him from the opposite side: "Hey! how do I get across?" "You are across!" Nasrudin shouted back.

From my memory of Apple's licenseing agreement:

If there is to be a transfer of ownership the seller must distroy all copies (including installations) before it is sold.

That means that if he sold it to you (since he has no previous system software) he would have to buy system software.

BTW - you cannot sell copies of the Mac OS that come bundled with a computer so, unless his previous version broke-run over by a chair prehaps, he should still have it (even if it was something like Mac OS 8.5).

All of this is pretty standard stuff for all software (not just Apple's)From a legal perspective you aren't buying a product, but rather a license to run the software and that license is only applicable to one computer.

well, duh. of course it's not.

if you get all the original cd's and packaging, and get him to give you a signed bill of sale transfering the licence to you, then it is his a** on the line, not yours. however, if you know he's not being honest about this (and you do) and *you* want to have a clear conscience, then i would say just spend the extra few $$ and get yourself a "clean" copy. (and tell your "friend" he's trying to pirate software...)

Jeez. If he was any kind of friend, he'd just burn you a copy of the disk. Pirating is bad enough, but pirating *AND* gouging a friend for $80? Tisk, tisk...

Remind your friend that the people that SELL pirated copies of software are typically the first people that the FBI goes after.

Also, I got my copy for $70--legally. If you are a student of any kind, you can get it from the Apple store online for $70. Why get a used copy?
