If there is someting here, it should be investigated and if proved, prosecuted. However, the usual caveats about allegations not being proof apply.

Could they do it without any superiors knowing that they did it?

I hope so but going on the Army's record to date, I think it's doubtful. It'll be investigated probably, but there won't be any prosecutions. Remember those two prisoners (low level Taliban types) that were killed by the application of blunt force to their skulls while being interrogated at Bagram Air Base in Afghanistan. The investigation came to the conclusion that their deaths where "homicides." No one was ever charged.

That's probably why supporters of the invasion feel comfortable stating that the interrogators should be prosecuted...knowing full well they won't be. It's sort of like offering to help with the dishes after they're already done...you get the brownie points without having to do the work.
Its easier to beg forgiveness than ask permission. Its easier to nonchalantly say "oh well, if they're guilty, I'm sure they'll be prosecuted" instead of setting up open purviews in the first place to prevent abuses in the second place....
