Ya, it looks pretty intentional to me. If you were planning to use something completely as your own, why would you ape the original so closely? Its not like that commercial was super ground breaking or anything.

I excpect intel did al the filming inside the factory anyway so its not like its apple thats copying them

I don't think Intel really gave a crap. They just issued a statement to distance themselves...like they weren't involve in the ad...it was all Apple's.

It does seem intentional, with just how exact a replica it is. But no doubt about it, it's a copy.
Methinks they would have to have permission to do that. Otherwise it's pretty blatant copyright infringement that would land them a lawsuit. Apple isn't that stupid... or I hope not, anyway.

Conrad said that Intel cooperated with Apple for some particulars of the TV spot, but added, "We didn't know what the end result was going to be."
The company did get a peek at the ad before Tuesday's keynote, but it wasn't too much earlier.
"It's probably a good thing that we didn't see them earlier," Conrad said.

We'll have to see how it pans out.
Sub Pop and Postal Service aren't gonna be too pleased - although this story is probably more publicity for both the label and the band than they could ever have afforded to pay for, so good for them.
Question is whether the directors will ever work again.

To everybody who shouts nonsense like "Apple are thieves":
The Apple marketing department works with a number of suppliers, ad agencies, PR agencies, you name it. Apple does not produce commercials in house, these are services they are buying in.
If they are being sold ideas that have already been sold to a different client then this is hardly Apple's fault, especially when the original video was relatively obscure. Apple will do a certain amount of due diligence on concepts, but there is only that much you can do. These thing have happened and will happen.

It may or may not have been Apple's "fault". Maybe they knew the work of those directors and that's the reason they hired them. On the other hand, if they didn't know their work (which seems unlikely) and have been sold an old idea again, if I would have been Apple I would have been a little bit annoyed now if I had to pay the full price for it. Those directors should charge "upgrade prices" for their clean room videos. On the other hand Apple doesn't have upgrade prices for iLife and Mac OS too, so I guess it's fine with them.
