ok got a question. How can I tell if an image that someone sends me to submit on a website is copyrighted without having to go through pages and pages of google image searches trying to figure out what the pic was originally called. Is there a way or software that can just find photos on the net that are like the one youre checking?.

Use tineye.com to find where it may also be posted. While this won't tell you "the owner of this picture does/does not want it posted..." it will show you how widespread it already is.
And TETENAL is right-all created works are copyrighted. The question really is, how can you tell if the owner cares?

...and if so, how much.

The only time you are ever truly safe is if you get the picture from a photo sharing site and the owner has specifically spelled out the rights to the image. And even then you are running the risk of that person not being the original copyright owner.

...thus "due diligence" investigations-with documentation of where you looked, whom you asked, and when you did all this is essential. If you made the effort and had convincing evidence that you had permission, it's on the person who (theoretically) lied and said he/she was the original owner if that person turns out not to be that original owner.

What if the camera auto-self-releases by mistake and takes a picture that no one’s the photographer of?
Does the camera own the copyright, then?

This is not entirely true. Old pictures eventually expire into the public domain. The owner of the picture may release it to the public domain early. And products of the US government are not copyrighted. Pictures taken by NASA or the military for example.

Are you putting up a website for them ?
Why not make THEM prove it, and make them sign a waiver that any copyright dispute stemming from the pics they submitted will be passed on to them.

tineye will tell you if it's already posted somewhere (at least in something close to the same form).
