What do you think - is this legit?

eBay link

A brand new 16GB 5th gen Nano for way less than a used 8GB goes for. The seller has 100% positive feedback...

Wife is using my old 2GB 2G Nano. I figured I'd pick her up something better for Christmas.

No, don't risk it, ipods sell in the technology markets for the same price as Apple retail here, they only nosedive if a new model is imminent.

www.apple.com.hk will give you the normal HK cost, if its much cheaper than this something is wrong.

We played with the new Nano Touch model but I didn't like it, plus she's already used to this interface.

That was in reply to moonmonkey, who seemed to imply that it couldn't be legit because prices don't drop that hard on current model.

It's not a current model.

I bit the bullet. Bought it on the 22nd, had it by the 29th. Pictures to come.

Odd thing is that the auction is completely gone from eBay and my Won/Purchased list.

Yeah, it's a fake. Here's how it shows up in System Profiler:

Definitely not real iOS.

The headphones are a knockoff of the old-style Apple earbuds, and the dock cable is clearly aftermarket, though the device is compatible with an Apple dock cable as well. It doesn't show up in iTunes, just as a flash drive.

I don't think I can appeal to eBay, as far as I know the seller disappeared. I'm headed to Paypal now to do something. If they won't listen then it goes to the credit card.

Of course it's not iOS. No nano runs iOS, even the real ones with touchscreens.

Just because the seller disappeared doesn't mean eBay has no records!!

Either way, by buying a fake — which was kinda entirely likely given the price — you help support the counterfeit industry. (I have no problem with knock-offs, provided they are advertised as such.) Please follow through and dispute this thoroughly.

When I worked in retail, we occasionally got customers coming in for tech support, honestly thinking they had a real iPod. We had to break the bad news and thoroughly document the fakes.

PayPal offered me a refund if I pay to ship the item back to China. Thinking about it.

Also, when I got the package, it was ripped open and had been taped shut with "Inspected by US Customs" tape. Apparently it was good enough to fool customs.

I told PayPal in no uncertain terms that I would not be sending back the "iPod" so that the seller can sell it to someone else. I told them I'd destroy it and provide proof of its destruction. Luckily I used a credit card to pay for this so if all else fails I'll go with that.

You should send it to Will it Blend. They can run a show on whether or not cheap knockoffs can blend as well as the real thing... then stick the fake iPod in their blender.

Interesting turn of events. After I refused to return it, I figured they'd cancel my claim right there, but I got this email today:

Seller's Name: 喻 海霞
Seller's Email: [email protected]
Seller's Transaction ID: 8YT05395G4658791F

Transaction Date: Nov 20, 2010
Transaction Amount: -$73.55 USD
Your Transaction ID: xxxxxxxxxxxxxxx
Case Number: xxxxxxxxxxxxxx

To continue, we need documentation supporting your claim that the item is
not authentic.

Here’s what you need to do.

1. Obtain a document from an unbiased third-party, such as a dealer,
appraiser, or an organization that is qualified in the area of the item in
question (other than you). This document should contain the following:
• Detailed description as to why the item is not authentic (i.e., how the
item differs from an authentic item, how the person evaluating the item
determined that it is not authentic, etc.).
• If possible, the document should include a serial number and must be on
letterhead that includes the name, address, and phone number of the
authenticating party so that we can contact them directly, if necessary.

2. Fax the documents to PayPal at 402-537-5760 (please note this is a
United States phone number, if you are faxing from outside the United
States, you will generally need to dial 00 1 before the number). Please
include a cover sheet with your fax that includes the email address
registered to your PayPal account and the ID number of your claim
PP-001-144-134-751. That way we can attach the documents to your claim as
quickly as possible.

3. We need to receive your fax by January 6, 2011 in order to proceed with
the investigation of your claim. If we don’t receive your fax by January 6,
2011, your claim will be canceled and no further action will be taken on
our part.

Please note that PayPal is unable to reimburse you for any costs or fees
that may be incurred in obtaining the requested documents. Any documents
you provide may also be supplied to the seller if necessary.

Thanks you for your cooperation and patience.

Sincerely,
Julie
Protection Services Department
PayPal, an eBay Company
I don't even know where I'd take it...an Apple store? The dude at Best Buy?

The terrible part is that they require I fax these documents in. Not because a fax is hard to come by, but because this means it's useless trying to send photographs of the many indications that this is a fake Nano. I got a real one so side-by-side photos would be easy.

Any ideas where I'd go to get this done? As best as I can tell, the seller is stalling and hoping that I'll be too lazy or cheap to get this taken care of. He underestimates how much free time I have.

I'd say an authorized Apple dealer would be the authority, and I bet they wouldn't charge you. Just write the letter for them so all they have to do is sign.

An Apple Store would be ideal. Not only can they confirm its (lack of) pedigree, they will meticulously document it so Apple can go after them. So bring the supporting documentation, too, if you're willing to share it with Apple.

Ha, similar story happened to my wife.

Bought a Ralph Lauren Rugby Shirt on a website, but didn't notice it was not an official company website.

Suddenly, we're charged from a Chinese vendor, and promptly get shipped a fake RL shirt from China.

Although payment was through Paypal (I know, alread a dead giveaway, my wife now knows better), I disputed this directly with my MC issuing bank. Dealing with Paypal is a pain in the ass.

Why would you buy a ruby shirt form Ralph Lauren when you're just going to get it all messed up at the match?

Latest counterfeit auction

The seller is brand new, location reported is "liaoningsheng, liaoningsheng, Japan." Liaoning Sheng is in China. Same stock photos and info copied and pasted from Apple. He's already sold 30 of them, I reported the auction, here's hoping they actually do something about it.

I went to a local Apple-authorized retailer today and they wrote up a quick blurb about how it's counterfeit and attached a business card. I attached the five-page document that I wrote up last night detailing every difference I could think of:

Authentic 5th generation Apple iPod Nano vs. Chinese counterfeit “iPod”

Device property differences:
There are significant dimensional differences (as-measured dimensions of the authentic iPod were within 0.03” of those reported by Amazon.com for an authentic 5th generation iPod Nano):

Authentic iPod Counterfeit “iPod”
Height 3.58” 3.70”
Width 1.50” 1.67”
Thickness 0.23” 0.34”
Screen size (diagonal) 2.20” 2.00”

-The counterfeit “iPod”’s surface is noticeably rougher than the authentic iPod, the quality difference can immediately be felt even by those unfamiliar with iPods

-The “hold” sliding switch at the top of the authentic iPod has been replaced by a sliding “On/Off” switch on the counterfeit iPod

-Looking from the front, the authentic iPod has the headphone jack on the left side of the bottom and the dock connector on the right side of the bottom, the counterfeit “iPod” has these ports swapped

-The rear of the counterfeit ‘iPod” identifies it as a model “A1137” which is actually the 1st generation iPod Nano model designation. The authentic 5th generation 16GB iPod model designation is A1320

-When connected to an Apple computer, an authentic 5th generation iPod Nano is reported with the following information:
iPod:

Product ID: 0x1265
Vendor ID: 0x05ac (Apple Inc.)
Version: 0.01
Serial Number: [deleted]
Speed: Up to 480 Mb/sec
Manufacturer: Apple Inc.
Location ID: 0xfd650000
Current Available (mA): 500
Current Required (mA): 500

The counterfeit “iPod” is reported with the following information:

USB DISK DEVICE:

Capacity: 15.82 GB (15,815,671,808 bytes)
Removable Media: Yes
Detachable Drive: Yes
BSD Name: disk3
Product ID: 0x1101
Vendor ID: 0x10d6 (Actions Semiconductor Co., Ltd.)
Version: 1.00
Serial Number: 单䑂卉K
Speed: Up to 480 Mb/sec
Manufacturer: GENERIC
Location ID: 0xfd650000
Current Available (mA): 500
Current Required (mA): 2
Partition Map Type: Unknown
S.M.A.R.T. status: Not Supported

Packaging and accessory differences:

-The authentic 5th generation iPod Nano is packaged with an Apple-branded dock cable and the latest model of Apple-branded headphones. The counterfeit “iPod” was packaged with counterfeit Apple headphones of an obsolete design that was phased out several years ago. The counterfeit “iPod” was packages with a generic non-Apple branded dock cable.

-The “iPod Nano” designation on the side of the counterfeit “iPod” packaging is not in the correct Apple-standard font

-The instruction manual included in the counterfeit “iPod” is written in poor English, contains diagrams of a previous generation iPod, and incorrectly shows ports on the iPod

-The markings on the counterfeit “iPod”’s case report it as a model A1199, which is a 2nd generation iPod Nano

-The markings on the counterfeit “iPod”’s case report it as serial number “7K639L5NVQ5,” which is the serial number for a 2nd generation iPod Nano

Operational differences:

-The counterfeit “iPod” must be powered on by switching the “On/Off” switch to “On,” then pressing and holding the “Play” portion of the click wheel. The “iPod” will then go through its full startup sequence. Once the counterfeit “iPod” is powered on, holding the “Play” button will power it down. The Apple logo is displayed each time the counterfeit “iPod” is powered up.

-An authentic 5th generation iPod Nano has no “On/Off” switch and is powered on by holding the “Play” button. Holding the “Play” button again will put the iPod to sleep, not power it down. The Apple logo is only displayed when doing a hard reset, which is very rare.

-On the counterfeit “iPod,” click-wheel navigation is clunky and poor. The wheel feels cheap and doesn’t respond well to input.

-The counterfeit “iPod”’s operating system is clearly a ripoff of Apple’s operating system, and a poor one at that. It is clear that the text was poorly translated into English (menu options on the counterfeit “iPod” include “Setting” (not “Settings” as on the authentic iPod)

-Menu options on the counterfeit “iPod” are completely different from those of the authentic iPod, as seen on this list of options available in each device’s main menu:

Authentic iPod Counterfeit “iPod”
Music Music
Videos Videos
Photos Photos
Podcasts FM Radio
Radio Camera
Video Camera Video Camera
Extras Extras
Settings Setting [sic]
Shuffle Songs ...
Now Playing ...

-When connecting an authentic 5th generation iPod Nano to a computer running iTunes, iTunes correctly identifies it as an iPod and allows you to transfer music, pictures, podcasts, videos, etc. to the device. When the counterfeit “iPod” is connected to a computer running iTunes, iTunes does NOT recognize it and as such all items on the device must be managed manually as if the device was a simple USB flash drive.

-When the counterfeit “iPod” is connected to a charging source, its screen displays the “charging” screen indefinitely. An authentic 5th generation iPod Nano’s screen by default goes to sleep while charging

-The video captured by the counterfeit “iPod” is of poor quality and very jumpy, indicating a low-quality camera and slow electronics. In contrast, the video captured by an authentic 5th generation iPod Nano is smooth and of high quality.

-When scolling through menu options on an authentic iPod Nano, the internal speaker plays a “clicking” noise as each option is passed. The counterfeit “iPod” has no such feature.

-The authentic 5th generation iPod Nano has an internal speaker capable of playing music when the headphones are disconnected. The counterfeit “iPod” has no such speaker and as such is incapable of playing music with the headphones disconnected.
