Well, I once read that sometimes, this kind of move makes sense to stake out turf and make it harder for others.
Creative is a nobody in the MP3 player market, Apple has much more competition from SanDisk and others. It might make it more expensive for them now, because of Apple acknowledging the patent, everyone will have to pay. And Creative might not seetle with them.
I also read that Creative will produce iPod accesories in the future, so surely, Apple will get something out of this deal.

The creative patent was filed in the mid-90s.
Who in the mid-90s had a music player with hierarchical menu? While you might say it wasn't non-obvious, there certainly was no prior art in the music player space.
Creative had this one in the bag. Apple knew it.

From the press release:
In addition, the companies announced that Creative has joined Apple's "Made for iPod" program and will be announcing their own iPod accessory products later this year.
It almost looks like Creative is getting out of the biz and instead is going to be an iPod accessory maker. They only had about 5% of the music-player market I believe, and they were bleeding money. Still, Creative was one of the few real competitors with the iPod.

I find it funny that they're going to be making speaker systems for the iPod now. But it does make sense for them. Besides they can still make the Zen and what not. But they've probably realized by now they have no chance if they try and go against Apple.

If you can't beat them... sue them. No need file bankruptcy anymore in the tech industry. Good laywers can keep you around for several more years no problem.

Correct. But to say Apple copied off Creative for using Menus in the iPod is a huge stretch.

One need not "copy" someone else's work to infringe on their patent. One might simply come up with the same sort of solution to a problem as a patent holder and then, through not doing a thorough enough patent search, quite innocently infringe on the patent.
I cannot believe Apple did not do a thorough enough patent search in the case of the iPod. But it's possible that they didn't search for the right things-until they were in production and it was too late.
