Timmy looked at me funny... I'm suing! Hah, I didn't read that whole 26 page PDF because it was boring. I hope someone makes a movie. The article mentioned Waypoint pirating technology from PowerLogix, they should make a movie "Pirates of Texas" or something...

Well, Powerlogix makes some claims that if true are sure to hurt everyone.
Reading all of it it would seem that most of the claims can be proven by Powerlogix legal documents and contracts, but at this point without seeing these documents and the proof that the other Co's were in breach I just don't know.
Here is what I do know:
No matter if any of it is true some Co is going under. Powerlogix seems doomed if they fail to get compensation. We all know how long that can take.
One way or the other it looks like we lose one of the upgrade makers maybe 2. Sonnettech looking better and better.
This sucks. Gaga Upgrades seem to me to be the best. I don't care much for Powerlogix or Sonnet as they are hard to overclock and seem to fail or have other trouble that Gaga seems to not have. On the support side Gaga seems to have the better here too.
If Gaga did enter in to this as claimed, what a foolish move. Seems to me that they are the only Co. that has hard assets. They other Co.'s will fold under and file for protection in bankruptcy while Gaga will lose real hard assets.
My take:
It's true and Powerlogix will win. I don't know if it will be in time to save them. I can for see a merger of Gaga and Powerlogix.

If this is truly Giga's own design and software, then why did the "Firmware Updater Application" that Giga supplied still have "Contact PowerLogix for assistance and do not shut down your machine!" in the code.
Come on. Now that's really stupid. Sounds pretty damning to me.

It looks like the FastMac upgrades are designed by AllMac, who is mentioned in the first Giga suit. If you check the FastMac FAQ page, note in the right sidebar: "Technical Support Provided by Allmac".
So our CPU upgrade picture looks like this:
PowerLogix = designs own, used Virtex to manufacture, now uses someone else
FastMac = designed by AllMac, unknown manufacturer (possibly themselves)
OWC = resells FastMac
Sonnet = designs own, unknown manufacturer (possibly themselves)
GigaDesigns = designs own with PowerLogix & AllMac help, manufactured by Virtex
NewerTech = designs own (only powerbook upgrades at this time), unknown manufacturer (possibly themselves)

I always wondered why Gigadesigns seemed to come out of nowhere with very good upgrades and prices. Stealing technology is one way...
That comment about Gigadesigns firmware update saying "Contact Powerlogix" sounds like a clincher.

I wouldn't support this company at all after trying to upgrade my pismo 400MHz with them since May of this year. I have received one duff upgrade which got sent back to them and I am now waiting for another one... I'm not holding my breath, but my dealings with this company lead me to believe that they probably deserve to be forced out of business. They have the worst customer service (other than VW) that I've dealt with to date.

Well, I've had the opposite experience.
I'm on my second G3 ZIF, the first being a 900MHz 750FX. It was DOA. I contacted PowerLogix and experienced the best customer service I have ever been through. They sent my replacement ZIF on it's way to me before the dead one had arrived back at their facility.
I have not had a single problem with my 1.1GHz 750GX ZIF.

Supposedly you should hang on for a week or 2 since that when the "new" stuff comes out. (Most of their stock is "backorder" anyway.)
