It is open to anyone who purchased Apple stock between July 19, 2000 and Sept. 28, 2000.

It hinges on the fact investors and analysts were consistantly told "All is well" up until the profit-warning announcement of last fall. The lawsuit also charges that Apple didn't know how to make perfect Cube cases, even though they claimed the Cube was a flawless model of perfection. It also charges that Apple let the iMac stagnate forever, missing the boat on CD-RW drives and 17 inch monitors while screwing with their education sales model and claiming, yet again....."All Is Well, Things Are Better Than Ever".

It's quite an interesting case. The actual court document is a very interesting read.

As I understand it, the suit is being brought by a law firm that specializes in suing corporations for perceived underperforming! Sounds like amublance chasing to me.

A father took his son to the cemetary, to visit the father's dad's grave. After a few minutes the son noticed a tombstone nearby which said, "Here lies a lawyer and an honest man". The son looked over and said, "Dad, do they bury two people in one grave?"

this will divide the crowd into those who bought stock to show support of the company and those who did it for their own gain. members of the second group should be rare.. they all know it hasn't been looking good for quite a while.

In other words, suing Apple for not having psychics on the board. Oh, and apparently to prove the plaintiffs know nothing about injection-molding too.

The word "frivolous" comes to mind...
